Pimping/Pandering

Prostitution is related to ¡§pandering,¡¨ which means to procure another person for the purpose of prostitution. The following activities constitute pandering:

„X Procuring another person for the purpose of prostitution.
„X Inducing, persuading, or encouraging another person to become a prostitute using promises, threats, violence, or by any device or scheme.
„X Arranging for a prostitute to stay in a house of prostitution for the purposes of plying the trade of prostitution, or anyplace in which prostitution is encouraged or allowed.
„X Inducing, persuading, or encouraging a prostitute to remain in a house of prostitution by promises, threats, and violence or by any device or scheme.
„X Convincing another person to either become a prostitute or to enter into a house of prostitution, by fraud or artifice, or by duress of person or goods, or by abuse of any position of confidence or authority. This includes the act of coming into or out of California for the purpose of prostitution.
„X Agreeing to, or actually receiving, any money or thing of value for procuring, or attempting to procure, another person for the purpose of prostitution, including coming into California or leaving California for the purpose of prostitution.

If a vehicle is used in the commission of prostitution or pandering, the vehicle may be declared a nuisance. A ¡§nuisance vehicle¡¨ means any vehicle used to agree to or engage in an act of prostitution, pandering or pimping, or to illegally acquire or attempt to illegally acquire any controlled substance; such a vehicle is a nuisance, subject to abatement, seizure and forfeiture. California Vehicle Code Section 22659.5 allows for the impoundment of the nuisance vehicle for a maximum of 48 hours. In addition, the offender may be ordered to not use the vehicle again for the purposes of prostitution or pandering. A violation of this order would result in a 48 hour impoundment.

Pandering is a felony, punishable by imprisonment in the state prison for 2, 4, or 6 years. However, if the prostitute is a minor over the age of 16 years, pandering is punishable by imprisonment in the state prison for 3, 4, or 6 years. But if the prostitute is under the age of 16, the offense is punishable by imprisonment in the state prison for 3, 6, or 8 years.
